Terms and Conditions

The information stated here are the terms and conditions under which you may use this website. These terms form a contract between the site owners/operators and yourself. Even though there is no fiscal consideration the contract is started and becomes enforceable when you join the site and agree to these terms and conditions, under which you agree to be bound. Please read carefully. If you do not agree with anything here and do not agree to be bound by these terms then please do not use the site.

Hereafter the site owners and operators may be referred to as "we" and "us" and the person joining as "you".

There are no other terms, conditions or contracts upon which use of this site is based. Commercial advertising on this site is handled under different terms and a separate contract.

The service.

The "service" is to facilitate its members with the opportunity to propose and then vote upon local and national issues. Nothing beyond that is offered nor implied and any level of success with influencing local political policy is not suggested nor guaranteed. The site supplies the opportunity only and does not guarantee that you will be able to influence anyone in local politics.

Changes to the service.

We reserve the right to make changes to the service and the website from time to time, which may have a direct baring on the members interests in this site. We reserve the right to add, alter, remove or disable functions, pages and facilities within the site. From time to time it may be necessary for users to alter/add/delete or amend their profiles entered to a newer format implemented by us.

We will try and give reasonable notice of any such changes to the service, but reserve the right to make sudden operationally necessary changes as and when we see fit.

We reserve the right to discontinue the service at any time without notice.

The user agrees not to hold the owners responsible for any losses suffered from a technical failure at the sites ISP (internet service provider) or the wider internet, resulting in loss of profile.

The user and member hereby acknowledges and accepts that they do not have the right to have all proposed questions accepted and that the final decision on such material lies with us.

Non commercial use.

The voting part of the site is for the use of the public and no company, body, political party, agency, club or corporation can be entered as an individual member.

Members of an organisation are welcome to join, but not the organisation itself.

The member hereby agrees to vote according to their personal conscience and not as part of a block for a given organisation.

Causing offence.

By using the site you agree not to be offended by any of the questions present inside and understand and hereby acknowledge that such questions are proposed by members of the public and not the site owners nor operators.

Spam & advertising.

By using the site you agree not to send any spam emails or expose members to spam email and to not send any advertising material to the site owners or other members. You agree to indemnify the owners for the full cost of any legal actions against them following a breach of this agreement and any costs to members for damage.

User cancellation.

You may terminate or suspend your membership at any time by clicking on SUSPEND or DELETE in the profile menu.

Membership

This site is open to all persons living in Wales over the age of 12. Even if a person is not Welsh or registered to vote in Wales they may use this site, suggest questions and vote, they simply need to be living in Wales (checks are made). This site is open to everyone without exclusion (see "fraud" below). If you are old, young, gay or straight, white or black, a judge, an asylum seeker or prison inmate - you are welcome to join and vote.

This site reserves the right to ban anyone it chooses where it feels that the individual is not using the site to the best interests of the site owners or the wider population of Wales. Anyone proposing questions that use bad language, sexual terms or references or clearly criminal or racist material will be banned.

Best interests

By using this site you agree to do so "in the best interests" of the owners and operators and the Welsh public.

The member confirms that they are over 18 (or that they are over 12 and have their parent or guardians permission) and state and warrant that they have no reason why they should not avail themselves of such a site.

The owners reserve the right to refuse the membership of anyone and further points out that any membership may be cancelled at any time without notice or reason This is a privately run site, not a government body, charity or public institution.

Offensive material. All proposed questions are screened before any member of the public can see them. By using bad language you achieve nothing, other than to get banned. Our software auto-deletes proposed questions that contain certain unpleasant words. It's your time you are wasting!

Pupils and schools

We have no problem with schools encouraging their pupils (over 12) to register and vote. An early introduction to democracy is always a good thing. Their security and privacy on-line is assured and no-one will ever gain access to their details for marketing or any other purpose other than that stated here. Pupils cannot contact each other and no-one will ever know that they are members or using the system. Privacy is assured.

A valid email address is required for each user and it cannot be used by more than 1 person. That email address is tested regularly and if it lapses the member account is closed immediately. You will have to re-join and enter your details again. If you know that an email address is about to change you can log in and alter the nominated email address in advance, but as soon as you do so you must use the new email account.

Fraud

If you know of anyone who asks you to join, and give them access to your account, let us know and we will ban that individual.

Hacking

All reasonable steps are taken to protect the site and its data from unauthorised hacking. If you are contacted by anyone, either by email or letter, and you suspect that they got your information from us we will investigate (within our abilities) and get the local press involved with the investigation as well. Theft of personal data is highly unlikely due to our security processes.

Browser problems.

The owners will not entertain technical questions as to the use of a members' computer, browser, its speed or ease of access nor any problems resulting on that members' computer as a result of using the service. All members agree that they are competent to use whatever method of access they have and further agree to deal with any browser problems through their own computer provider. The service does not place cookies onto the members' computer that persist after the site is closed, nor any other background software.

Password cookies.

For the purposes of safety and privacy no username/password cookies are created or used.

Members agree to check for viruses on all emails between themselves and the owners/operators.

Commercial links.

From the site you may see advertisements from local companies. The owners do not endorse nor warrant the activities of any such advertisers and you use their sites at your own risk. The user agrees and warrants that if they have any problems with such sites they will not hold this site's owners responsible in any way.

Limitations and liability

The owners and operators of the site accept no responsibility whatsoever for any unwanted side effects to using the site, loss of time or frustrations caused. By using the site you are agreeing that you understand the purposes and aims of the site, that you have read the information pages and all of these terms and conditions, and that you do not nor will ever hold the site owners responsible for any loss suffered as a result of using the site.

By using the site and accepting its terms you hereby acknowledge that we make no guarantees whatsoever that your votes will count towards influencing local politics. You make the effort to vote in the 'hope' that your collective votes may influence local politics.

Data protection

We are notified under the Data Protection Act 1984 and undertake to abide by all its rules and guidelines. We undertake to take all reasonable security and back-up measures to protect private information. We hereby state that, at this time, no private information collected by the site will be accessible by any unauthorised persons or used or passed on for marketing purposes, other than to do with this site and its content and nature. Please report any suspected violations to us immediately.
